TERMS & CONDITIONS – GIRALDILLA INVESTMENTS S.L. / INBOUND SPAIN
NOTE: BY SENDING US YOUR INITIAL DEPOSIT (OR ANY SUBSEQUENT PAYMENT) TOWARD YOUR TRIP COST, YOU CONFIRM YOUR ACCEPTANCE OF THE FOLLOWING TERMS & CONDITIONS.
The Sale and execution by Giraldilla Investments S.L., a private company with identification number C.I.AN-297947-3 and fiscal registration number B10558393, with company address on Calle Sierra Blanca, 2, 3-C, Marbella, Malaga, Spain 29601, a retail travel company operating under the commercial name Inbound Spain SLU 0454738/1 (herein after the “Organizer”), of packages concerning Tourist Services or individual Tourist Services to be provided on Spanish or international territory is subject to these general conditions, where not derogated from specific agreements contained in the Contract and the Spanish law, in particular the provisions of Legislative Decree no. 79 of 23.5.2011 (the “Tourism Code”) as well as, as applicable, to Law n.1084 of 27.12.1977 ratifying and executing the International Convention relating to the travel contract (CCV), signed in Brussels on 23.4.1970.
1.1 These terms and conditions and the privacy policy (“Agreement”) set out the basis upon which clients (“you” or “travelers”) agree to and accept the services provided by Giraldilla Investments S.L. and the trade name Inbound Spain (“us” or “we”) for trip reservations and other travel requirements.
1.2 This Agreement shall start upon receipt by us of (i) any deposit or (ii), in the case of a late booking, upon receipt of full payment of the relevant trip. Your use of our services also confirms that you have read and accepted these terms and conditions.
1.3 If you are traveling with other people, you agree to make all such people aware of these terms and conditions and privacy policy.
1.4 We may amend our terms and conditions at any time without notice. It is therefore important that you read these each time before confirming your trip, even if you have used our services in the past. The most recent version of our terms and conditions can be found on this page. Should they change after your confirmation, the terms in place at the time of your confirmation will apply to your trip.
1.5 Under the license number C.I.AN-297947-3, Inbound Spain complies with legal, financial, and insurance requirements under Spanish law and travel agency regulations.
2.1 In many instances, Inbound Spain acts solely as the intermediary of all suppliers of accommodation, transport, tour guides, tour providers, attractions, and activities, and not as principal. These suppliers are independent. You acknowledge and agree that we are not responsible for any loss, damage, delay, inconvenience, or injury to you as a result of any act or omission of these suppliers, their employees, agents, servants, or representatives.
2.2 While we use all reasonable efforts to choose quality suppliers and conduct regular inspection visits to ensure quality standards are maintained, no undertaking, guarantee, or warranty is given or shall be implied as to the fitness or condition of any goods or services provided by the supplier, including accommodation, activities, transportation, food, or drink. The services provided by these suppliers are subject to the laws of the place where the services are provided and any conditions imposed by those suppliers. You acknowledge and understand that we have no liability for the current provision of arrangements or services provided by these suppliers. The liability of such suppliers may be limited by their terms and conditions, tariffs, conditions of carriage, tickets, and vouchers, as well as international conventions and agreements.
2.3 Supplier pricing and availability may change without notice. You agree that we are not responsible for any errors or omissions in any quotes or advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, nor are we responsible for any errors or omissions due to incorrect information from third parties.
3.1 All payments can be made by bank transfer. To ensure the security of your confidential data and proper handling of sensitive information, we accept payments through a secure platform. Details on how to proceed will be communicated to you in due course.
3.2 Except in the case of Late Bookings (see section 3.4), a deposit of 30% of the full cost of your trip (the “Deposit”) is payable upon your confirmation to proceed with the booking, with the balance due 90 days before the arrival date. Until we receive the Deposit, we will not make any reservations on your behalf, and prices, availability, and trip arrangements are not guaranteed. If we do not receive full payment by the due date, your booking may be treated as canceled by you in accordance with section 5.
3.3 Once we receive the Deposit (or in the case of Late Bookings, full payment), we will send you a written confirmation via email detailing your booking (the “Travel Information”). The Travel Information will include your itinerary, commencement date, total cost, payment received, and balance due date.
3.4 A Late Booking is a trip booked within 90 days of its start date. For Late Bookings, the full trip cost is payable upon your confirmation to proceed with the booking. You can book your trip at any time, up to the day of departure, depending on availability.
3.5 We do not charge extra administrative fees for Late Bookings. However, Inbound Spain requires a non-refundable €250 planning fee for reservations within 90 days of arrival upon acceptance of a preliminary itinerary and price. The planning fee will be applied to your payment. We recommend booking in advance to secure your preferred arrangements and the best prices.
3.6 Final trip documentation will be sent via email 20 days before travelers’ arrival.
3.7 Solvency & Liability: Giraldilla Investments, S.L. is a privately held and debt-free company. Each trip payment we receive is deposited exclusively into that client’s trip fund, and these monies are never used for alternative purposes. Certificates of solvency and liability insurance are available upon request. HISCOX, S.A. SUCURSAL EN ESPAÑA – GRUPO INNOVAC, S.A. hereby certifies having signed insurance contract no INNO000452, with effective date 01/01/2025 and expiration date 12/31/2025 with Giraldilla Investments, S.L. Tax I.D. B10558393 for travel agency. The aggregate limit of liability established in the contract is: €600,000.
Inbound Spain provides fully inclusive trip pricing, which may include accommodations, transportation, meals, private tours, special experiences, VAT, and other services as applicable. Itemized costs of trip elements are not provided. All prices are inclusive of our handling fees and VAT, except for Tourism Taxes, which are charged additionally. All trips are priced in Euros.
5.1 You must notify us of any cancellation by telephone at +34 699 176 989 during office hours or by email to info@inboundspain.com. Notice of cancellation is only effective upon receipt.
5.2 All cancellations and no-shows are subject to the following non-refundable cancellation charges:
5.3 These charges apply to all bookings unless suppliers’ own cancellation charges are higher. If applicable, amended cancellation charges will be provided at the time of trip confirmation and can be up to 100% cancellation for certain services and times of the year.
If You Change Your Booking
6.1 If you wish to change your booking, please notify us in writing (email is acceptable) as soon as possible. We will do our best to accommodate your request but cannot guarantee that all change requests will be met. We may charge a non-refundable amendment fee per person to cover the administrative costs of such changes. Furthermore, we will inform you of any amendment fee when we receive your change request.
6.2 You agree to cover any expenses that arise from the requested changes, including cancellation fees payable to hotels and other suppliers, as well as costs associated with airlines or train tickets. Some services may be non-refundable immediately upon booking, and certain airlines may treat name or other changes as a cancellation requiring the purchase of a new ticket.
6.3 While we strive to avoid modifying your trip, adjustments may be necessary. If any aspect of your booking must be altered, we will make every reasonable effort to notify you promptly. Subject to section 8, if a proposed change is unacceptable to you, you may cancel the specific part of your booking that relates to the change and receive a full refund for that part. This refund shall be considered a full and final settlement, and no further refunds or compensation will be provided.
6.4 In exceptional circumstances, we may be forced by “force majeure” (see section 7) to change or cancel your trip. While rare, if such a situation occurs, we will unfortunately be unable to provide refunds, compensation, or cover any costs or expenses you incur.
Except where otherwise stated, neither we nor our suppliers are liable for any loss, damage, compensation, cancellation, or expense you may incur due to an inability to perform contractual obligations arising from an event of ‘force majeure.’ In this context, ‘force majeure’ refers to events beyond our or our suppliers’ control, which could not be foreseen or prevented despite all reasonable efforts. These include but are not limited to war, civil strife, terrorist activity, industrial dispute, natural or man-made disasters, adverse weather conditions, pandemics, and closure of borders or airports.
In a force majeure situation, such as Spain being closed to visitors, we will not apply the standard cancellation terms under section 5.2 but will instead offer credit* for a rescheduled trip.
*Credit does not include non-refundable items such as domestic flights, high-speed train tickets, pre-purchased admission tickets, and similar costs, which would be deducted from the credit offered.
8.1 By choosing to travel with Inbound Spain, you accept the risks inherent in travel. Subject to the remainder of this section, you assume full responsibility for any loss, injury, death, or damage to yourself, your family, dependents, or property arising in connection with the trip.
8.2 Our trip costs are based on clients agreeing to these terms and conditions. Inbound Spain primarily acts as an intermediary, arranging services with independent suppliers for accommodations, activities, and other travel needs. As such, you release us, our employees, agents, and suppliers from liability for any economic loss, physical or mental injury, illness, permanent disability, or death arising directly or indirectly from the trip, except where such loss, injury, or damage is caused by reckless or fraudulent conduct on our part. In cases where Inbound Spain directly provides transportation or guide services, you agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses resulting from incidents beyond our control. Should you wish to make a claim against us, it is your responsibility to demonstrate that we, or our supplier(s), were negligent.
8.3 We do not accept liability for:
8.4 If we are liable to you, our maximum liability will be limited to the full cost of your trip.
8.5 You are responsible for any losses, damages, or claims arising due to any misconduct by you or your party members. If any claims are made against us due to your actions or omissions, or those of your party members, you agree to indemnify us for such amounts, including any penalties or interest.
9.1 We are dedicated to making your trip as enjoyable as possible. We ask that you respond to our queries promptly to avoid delays in creating a customized experience.
9.2 It is your responsibility to ensure that you have a valid passport and any necessary visas, as well as that you meet entry requirements for your destinations and return home. Entry requirements vary and may change. While we do our best to inform you of relevant regulations, please confirm with the appropriate embassies or consulates and your airline.
9.3 You are responsible for verifying the accuracy of your travel documents and notifying us immediately of any errors. These documents are valuable, and we cannot be held responsible for loss, theft, or damage, except when in our care (subject to section 7).
9.4 We strongly recommend purchasing comprehensive travel insurance suitable for your trip and that each member of your party has coverage before departure.
9.5 We are not responsible for delays, changes, or costs due to incomplete, expired, or inaccurate travel documentation or insurance.
9.6 You are responsible for ensuring that neither you nor any party members behave in a manner that may cause danger, distress, offense, or damage to others or property. If such behavior occurs, we may take appropriate action, including canceling your trip. In this case, you will not be eligible for refunds, compensation, or reimbursement of expenses incurred due to cancellation.
Inbound Spain at all times observes the current provisions on data protection, in particular, the new European regulation on data protection.
At Inbound Spain as responsible for the processing of your data, with address at Calle Sierra Blanca, 2, 3-C, Marbella, Malaga, Spain 29601, telephone +34 699 176 989 and email info@inboundspain.com, we process the information you provide to deliver the requested service and perform billing. The legal basis that legitimates this treatment will be the need to manage a contractual or similar relationship.
The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with the legal obligations.
Some personal data must be communicated to the different providers of services for the realization of the acquired service and to fulfill the purpose of the contract. The management of the contracted services may involve the communication of your data to collaborating companies and organizers of your trip.
You have the right to obtain confirmation of whether we are dealing with your personal data at Inbound Spain; therefore, you have the right to access your personal data, correct inaccurate information, or request its deletion when the data is no longer necessary.
You and the rest of the interested parties can expand information in this regard, or if you wish to exercise your rights of access, rectification, cancellation / suppression, opposition, limitation, or portability, you can do so by sending an email to info@inboundspain.com indicating in the subject “Data Protection” or by sending a request in writing to: Calle Sierra Blanca, 2, 3-C, Marbella, Malaga, Spain 29601 together with valid proof of identity, such as a photocopy of your DNI or passport.
By sending us the Deposit (or, in the case of Late Bookings, the full payment), you confirm that neither you nor anyone traveling with you has a condition or disability that would make traveling unsafe for yourself or others. We recommend that you seek current health advice for necessary precautions before your trip.
We aim for complete customer satisfaction. If you are not satisfied with our services, please notify us promptly by calling +34 699 176 989 during office hours or by emailing info@inboundspain.com. We will make every reasonable effort to resolve your complaint promptly. If the issue remains unresolved, you may submit a written complaint within 14 days of returning from the trip.
These terms and conditions, as well as any matters arising from them, are governed by Spanish law and subject to the exclusive jurisdiction of the Spanish courts.
